Loretta Lynch And The Government War On Free Speech

During her appearance before the Senate Judiciary Committee last week, Attorney General Loretta Lynch admitted that she asked the FBI to examine whether the federal government should take legal action against so-called climate change deniers. Attorney General Lynch is not responding to any criminal acts committed by climate change skeptics. Instead, she is responding to requests from those frustrated that dissenters from the alleged climate change consensuses have successfully blocked attempts to create new government programs to fight climate change.

These climate change censors claim that the argument over climate change is settled and the deniers’ success in blocking congressional action is harming the public. Therefore, the government must disregard the First Amendment and silence anyone who dares question the reigning climate change dogma. This argument ignores the many reputable scientists who have questioned the magnitude, effects, and role of human action in causing climate change.

If successful, the climate change censors could set a precedent that could silence numerous other views. For example, many people believe the argument over whether we should audit, and then end, the Federal Reserve is settled. Therefore, the deniers of Austrian economics are harming the public by making it more difficult for Congress to restore a free-market monetary policy. So why shouldn’t the government silence Paul Krugman?

The climate change censorship movement is part of a larger effort to silence political speech. Other recent examples include the IRS’s harassment of tea party groups as well as that agency’s (fortunately thwarted) attempt to impose new rules on advocacy organizations that would have limited their ability to criticize a politician’s record in the months before an election.

The IRS and many state legislators and officials are also trying to force public policy groups to hand over the names of their donors. This type of disclosure can make individuals fearful that, if they support a pro-liberty group, they will face retaliation from the government.

Efforts to silence government critics may have increased in recent years; however, the sad fact is the US Government has a long and shameful history of censoring speech. It is not surprising that war and national security have served as convenient excuses to limit political speech. So-called liberal presidents Woodrow Wilson and Franklin Roosevelt both supported wartime crackdowns on free speech.

Today, many neoconservatives are using the war on terror to justify crackdowns on free speech, increased surveillance of unpopular religious groups like Muslims, and increased government control of social media platforms like Facebook and Twitter. Some critics of US foreign policy have even been forbidden to enter the country.

Many opponents of government restrictions on the First Amendment and other rights of Muslims support government actions targeting so-called “right-wing extremists.” These fair-weather civil liberties defenders are the mirror image of conservatives who support restricting the free speech rights of Muslims in the name of national security, yet clam to oppose authoritarian government. Goldman: “The S&P 500 Is Overvalued”

Nearly three weeks ago, when looking at the incoming Q4 results, we were stunned by an unprecedented divergence: that of GAAP and non-GAAP earnings. We showed this difference as follows:

… and noted that while on a non-GAAP basis, the S&P’s trailing P/E is a relatively rich 16.5x (over 17x as of today), it was the GAAP P/E that was troubling, because at just 91.5 in S&P500 EPS, this implies that the GAAP P/E of the overall market is now a near-record 22x.

We next showed the delta between GAAP and non-GAAP as follows:

At a dollar difference between the two “earnings” series of $26.5, this was the widest such spread since the financial crisis.

Unsure what to make of a spread that was so gaping, and a market that is so broken not to notice, we concluded as follows:

What can possibly short-circuit this positive feedback loop which leads to ever lower earnings, and increasingly lower prices? Two years ago we would have said another major central bank intervention or trillions in new Chinese loans. However, with both of these loopholes largely played out – China’s debt/GDP of 350% means that the entire nation is on the brink of a Minsky Moment collapse at any, well, moment, while recent central bank intervention have only led to even greater market volatility – this time around we don’t know what the true answer is. In fact, it just may be that this time around the market will actually have to crash, like it did in 2008 when the GAAP to non-GAAP spread was just as vast, for the great Wall Street “phony earnings” game to start from scratch.

What we forgot was the desperate actions by the ECB which may have kicked the can by a few more months, in the process sending the S&P 500 to an even more overvalued state.

But while for now the market is stubbornly refusing to crash, someone else noticed our analysis: Goldman Sachs’ chief strategist David Kostin who presents the following oddly familiar (granted we use column charts; Goldman uses line charts) of GAAP (or rather “operating”) vs non-GAAP earnings and the spread between them…

… and says “only three times during the past 25 years has the difference between operating and adjusted EPS exceeded 10%. In 2015, the gap totaled a staggering 18% or $18 per share, with impairment charges by Energy firms responsible for half the difference. Last year’s difference was only surpassed by the record 31% gulf in 2009 at the depths of the global financial crisis.”

Then there is the question of the drop in earnings, because as we pointed out it is not so much about the 4th consecutive Y/Y drop in EPS, but the gargantuan 12.3% crash in 2015 GAAP EPS which even Factset pointed out over the weekend.

The political establishment in America is terrified.

Donald Trump gets closer to securing the GOP nomination with each passing month and his rivals on both sides of the aisle are in disbelief.

Worse – or “better” if you enjoy entertainment – Trump has seemingly given up any attempt to be anything other than… well… than Donald Trump. He recently offered to pay the legal fees of a supporter who punched a protester, shouted almost maniacally about “Bernie guys” at a recent rally, and frankly seems to have gone punchdrunk with his newfound political clout.

That’s not necessarily a criticism. Heaven knows it’s funny and obviously there’s something highly satisfying about watching the establishment squirm.

All the same, no one – not even Trump’s staunchest supporters – really know what to expect from a Trump presidency. And virtually no Washington veterans want to find out. In fact, as we reported last week, a group of GOP and tech execs recently made stopping Trump the topic of the American Enterprise Institute’s annual World Forum, a secretive affair held on Sea Island, Georgia.

And although everyone now jokes about just how unstoppable the Trump “juggernaut” has become, the establishment isn’t called “the establishment,” for nothing. Trump may have proven remarkably adept at whipping certain sectors of the electorate into a veritable frenzy, but he himself will tell you that he’s no politician. In fact, he prides himself on being “outside the political fold,” so to speak.

He may know quite a few tricks in the boardroom, but he doesn’t know all of the tricks of the political trade, and as Bloomberg outlines below, he could still have the nomination “stolen” from him, if the party pulls out all of the stops.

On Saturday morning, while the candidates were scattered across Ohio and Florida, Illinois and Missouri, Cruz’s campaign was back in Iowa trying to wring another victory out of the state that gave him the first win of the primary season. US Kills ISIS Supreme Military Commander – Who The US Trained

Meet Abu Omar al-Shishani, or, “Omar the Chechen.”

Al-Shishani is Islamic State’s “minister of war,” and on March 4, the US tried to kill him.

Initially, reports indicated that an airstrike in the northeastern Syrian town of Shaddadi likely succeeded in “eliminating” the militant. But “on-the-ground” intelligence from London-based Syrian Observatory for Human Rights (who else?) suggested that in fact, al-Shishani was still alive and had been transported to Raqqa where he was being treated for serious injuries.

Fast forward to Monday and we find out that even if al-Shishani isn’t technically dead, he is now “clinically dead,” which according to Rami Abdel Rahman (who runs the one-man Observatory for Human Rights) means “Shishani is not able to breathe on his own and is using machines.”

“He has been clinically dead for several days,” Rami adds.

When the US announced the strike last Tuesday, officials likened Shishani to “the ISIS equivalent of the secretary of defense,” although we have to say, he doesn’t look much like Ash Carter.

He was one of the most wanted ISIS militants and the US had a $5 million bounty on his head. And it’s easy to understand why. America trained him. And not in some “somebody allegedly saw him with John McCain in 2010” type of way. But literally.

Consider the following excerpts from a McClatchy story you might have missed in September of last year:

Abu Omar al Shishani, as he’s now known, had been born Tarkhan Batirashvili 27 years earlier in Georgia’s Pankisi Gorge, a tiny enclave of ethnic Chechens, known locally as Kists, whose roughly 10,000 residents represent virtually all of the Muslims in predominantly Orthodox Christian Georgia.

But analysts of extremist groups said Batirashvili’s impact has been far greater than the small numbers of Muslims in Georgia would suggest. Since he swore allegiance to the Islamic State in 2013, thousands of Muslims from the Caucasus have flocked to Syria to join the extremist cause.

“More than anything else, Batirashvili has legitimized ISIS in the Caucasus by the power of his exploits, which is amplified by slick ISIS propaganda,” said Michael Cecire, an analyst of extremism for the Philadelphia-based Foreign Policy Research Institute.

Batirashvili’s battlefield successes, including orchestrating the capture of Syria’s Menagh Air Base after two years of failed attempts, “helped to legitimize ISIS in militant circles, including in the North Caucasus,” Cecire said.

Batirashvili’s story also was compelling, Cecire said: “A man with a modest background, sickly and impoverished before he went to Syria,” becomes “a great battlefield commander defying the world” . . . a “seemingly emulable, rags-to-riches story.”?
